PRIVACY POLICY

Marketing Analysts, LLC (“MAi”) values the privacy of visitors to its website at www.mairesearch.com (the “Site”).  MAi also believes that individuals should be empowered to protect their own information.  This Privacy Policy (“Policy”) is intended to give users of the Site information on what information MAi collects on the Site, how MAi uses that information, and the choices that users have regarding their information.  Any questions or concerns by a user regarding the privacy of his or her information in connection with this Site should be directed to MAi as set forth below.

This Policy covers only information collected on or through this Site from individuals visiting the Site.

MAi may change the terms of this Policy at any time.  If MAi does so, it will notify you here.  The date at the top of this page will reflect the last update.  You should check this page regularly to check for updates. Your continued use of this Site after any changes in these terms constitutes your agreement with these terms.  MAi reserves the right to modify or discontinue this Site at any time.

  1. Information Collected:

MAi collects some personal information from users of this Site.  Examples of personal information that MAi collects from you include your name and email address when you (i) comment on blog posts and/or other content made available on the Site; (ii) send us questions or comments; and/or (iii) request additional information from us.

In addition, MAi collects the following types of information from your web browser or interactions with or use of this Site:

  • Details about your computers, devices, applications and networks (including IP address, browser characteristics, device ID and characteristics, device operation system information, and system language preferences);
  • Your activities on the Site and usage patterns, referring URLs, dates and times of visits to the Site, and information commonly recorded in web server logs;

MAi uses “cookies” (small pieces of information placed on your computer hard drive that may take the form of html files, Flash files or other technology) on certain parts of our Site to allow us to remember user activity and visits to the Site.  For instance, cookies may be used to remember portions of the Site that you previously viewed or they may store a username and/or password that you provided when you commented on blog posts, etc.  MAi does not use cookies to collect personal information, but MAi may link information contained in a cookie to your personal information.  You can program your computer to warn you each time a cookie is being set, or you can disable cookies on your computer by selecting this preference or option located in the menu of your browser.  By blocking cookies, however, you may not have access to certain features of the Site. There is no other tracking technology utilized on this site. In addition, this site does not change its behavior due to “Do Not Track” requests.

MAi does not knowingly actively allow other parties to collect personal information about your online activities over time and across different websites when you use the Site.

MAi also uses technology to count visitors to the Site and analyze how visitors use the Site.  This information generally is anonymized instead of being used to identify a particular user. 

MAi also maintains log files of traffic that visits the Site.  MAi’s servers are designed to automatically record the information that you or your web browser sends when you visit the Site.  These log files include information such as your requests, IP address, browser type, browser language, the date and time of your request, and one or more cookies that may uniquely identify your system.

  1. No Assurances of Privacy.

MAi will take commercially reasonable steps to safeguard all personal information provided by you using this Site from unauthorized access and use, including using commercially reasonable physical, administrative, and electronic security measures.  Unfortunately data, including e-mail and electronic communications, submitted over the Internet is subject to the risk of being accessed by unauthorized third parties.  No security system is fail-safe and MAi cannot guarantee the information you provide will never be obtained by unauthorized persons.  By using this website, you acknowledge and accept this risk.

As between you and MAi, any information or material submitted to MAi in connection with this Site is provided on a non-confidential and non-proprietary basis.  By submitting information and material through this Site, you authorize MAi to use that information.

  1. Use of Information.

MAi uses the information submitted through this Site for various purposes, including responding to your questions and adding you to distribution lists for information and materials relating to MAi.  Information or materials submitted by users of this Site may be used by MAi for any purpose on an unrestricted basis, including but not limited to reproduction, display, performance, modification, transmission and distribution.  MAi is also free to use any ideas, concepts, know-how or techniques submitted to MAi for any purpose on an unrestricted basis.  Without limiting the foregoing, MAi uses the information that it collects to provide services to businesses; conduct research and analysis (for example, market and client research); analyze security; analyze the behavior of Site users; customize and improve the Site’s properties; analyze and develop new products, services and websites; comply with and enforce applicable legal requirements, agreements and policies; and perform other activities consistent with this Policy.

MAi does not intentionally reveal any personal information that is provided by you through this Site to any third parties, except (i) when requested to do so by a third party service provider that is subject to rules of confidentiality and under a contract between MAi and such provider and only when such disclosure is necessary for the provision of such services; or (ii) when requested by a governmental agency having jurisdiction, or by a court of competent jurisdiction or other operation of law; or (iii) when MAi believes disclosure is necessary and appropriate to prevent physical, financial or other harm, injury or loss or in connection with an investigation of suspected or actual illegal activity or exposure to legal liability.  

  1. Managing Information You Provide.

You can stop providing the information collected by MAi through this Site simply by ceasing to use the Site.  You also can choose to no longer provide personal information through this Site by ceasing to provide it.  MAi will retain some of the information you already provided, such as your email address, name, and other contact information.

Any non-MAi web site accessed through this Site is independent from MAi.  MAi has no control over such independent sites and is not responsible for the availability, content or use of those sites, including any link contained in those sites or any changes or updates to those sites. MAi makes no representations whatsoever about any other site you may access through this Site.  Reference by MAi to another site does not mean MAi endorses or accepts responsibility for the content or use of that independent site or has any association with it or its operators.

  1. Applicable Law and Forum.

You agree that this Policy is governed by the laws of the State of South Carolina. You hereby consent to the exclusive jurisdiction of the state courts of Charleston County, South Carolina and in the federal courts in the District of South Carolina, Charleston Division for any claim or dispute arising from this Policy. You are responsible for compliance with all applicable laws.

California Civil Code Section § 1798.83 permits users of the Site that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.
